DMCA

At Company Alarm, we value the intellectual property rights of others and expect our users to reflect the same values. If you believe in good faith that a user has uploaded content to a Company Alarm website that may infringe your copyright(s), please send us a takedown notice as required below.

Digital Millennium Copyright Act (“DMCA”) Notice
For copyright infringement notices, Company Alarm will only remove content based on a complete DMCA Notice. Your complete DMCA Notice must include all of the following information:

  • A detailed description of the copyrighted content that you believe is being infringed;
  • The URL where the allegedly infringing content is located and a description of the content;
  • Your full legal name, physical address, telephone number, and email address;
  • The following statement: “I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law”;
  • The following statement: “The information in this notice is accurate and, under penalty of perjury I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed”; and
  • The electronic or physical signature of the copyright owner or authorized agent.

Upon review of a complete DMCA Notice, Company Alarm will remove the allegedly infringing content. Company Alarm will further make a good-faith attempt to contact the user who stored or transmitted the allegedly infringing content to provide such user the opportunity for a response to the removal of their content (a “DMCA Counter Notice”).

DMCA Counter Notice
If you believe your content was removed by Company Alarm based on an improper DMCA Notice (for instance, the content was removed as a result of a mistake or misidentification), you may file a DMCA Counter Notice with Company Alarm and request that Company Alarm restore placement of your content. Company Alarm will only restore your content if you provide us with all of the following information:

  • A detailed description of the content Company Alarm removed and the URL(s) where the content appeared before removal;
  • Your full legal name, physical address, telephone number, and email address;
  • The following statement: “Under penalty of perjury, I have a good faith believe that the content described in the DMCA Notice was removed or disabled as a result of mistake or misidentification”;
    The following statement: “I consent to the jurisdiction of Federal District court for the judicial district of the [Add Desired District], and I will accept service of process from the person who provided the DMCA Notice or an agent of such person”;
  • Your electronic or physical signature.

Company Alarm may, in its sole discretion, reinstate the content based on the DMCA Counter Notice. However, in no event will Company Alarm reinstate the content if it receives notice from the copyright claimant that a legal action to restrain the allegedly infringing activity has been filed.
